Application to the CMO office

The couple applies to the District Medical Board (a panel of senior doctors in your district) with medical records showing why surrogacy is needed. A government hospital examines the couple and issues the Certificate of Medical Indication (Form 12), which explains why surrogacy is needed. You supply your medical history and your treating doctor’s supporting documents. The Board examines the file and issues a certificate of medical indication. The Appropriate Authority then issues the Certificate of Essentiality, its written proof that surrogacy is medically necessary for you. The surrogate gives written consent after the risks are explained to her, and a fitness certificate is obtained. A written agreement between the couple and the surrogate is prepared, usually with affidavits (sworn statements signed before a notary). The couple and the surrogate apply to a Magistrate (a court officer of the first class or above). The order says the child to be born will legally be the couple’s child. It is needed before the procedure. The procedure and pregnancyप्रक्रिया और गर्भावस्था
The clinic carries out the embryo transfer (placing the embryo in the surrogate's womb). It may not work the first time. At least one gamete (egg or sperm) must come from the couple. The order of steps 2 to 6 can vary by state and by clinic. Ask your clinic for the exact sequence your Appropriate Authority expects. Form 12: Certificate of Medical Indication
The medical certificate. The examining gynaecologist at the government hospital certifies the medical condition and that surrogacy is needed, after checking the couple’s reports. It carries the wife’s photo and is countersigned by the Medical Board chairman.

Does the surrogate have to be a relative?क्या सरोगेट का रिश्तेदार होना ज़रूरी है?
No. The Act requires a willing woman. This is a common point of confusion, and some offices have asked for proof of a family relation. - The 2019 Bill said “close relative”. The Rajya Sabha Select Committee examined the Bill, and the word was replaced with “willing woman”. If a document is in a regional language, get an official translation. Insurance for the surrogate mother
The Act requires 36 months of health cover for the surrogate, paid for by the couple. In May 2023 the insurance regulator (IRDAI) directed all insurers to offer cover for surrogates.

- Day-care treatment, and costs shortly before and after a hospital stay
- Cashless treatment at the insurer's listed hospitals, or you pay and claim it back
- Check that there is no initial waiting period for surrogacy complications
Not covered
- Surrogacy consultations (doctor advice before the procedure)
- The treatment itself: injections, tests, ultrasound, embryo transfer, egg pick-up
- Delivery expenses, normal or C-section
- Doctor visits that do not need a hospital stay (OPD)
- Illnesses you already had usually have a waiting period
These are the costs the couple pays the clinic directly, so keep them in the medical expenses agreement. Please confirm the delivery exclusion with the insurer.
Check before you buy
- The period is at least 36 months and starts before the embryo transfer.
- The insured person is the surrogate mother, and the certificate shows her name.
- Pregnancy, post-delivery complications and hospital stays are covered, and the waiting period does not block surrogacy claims.
- Your Appropriate Authority accepts the certificate. Keep a copy for the Board and the Magistrate.
Insurers that publish information on surrogacy cover
No named surrogacy product could be verified at every insurer, so ask each one for surrogate cover specifically.

Is surrogacy legal in India?क्या भारत में सरोगेसी कानूनी है?
Yes, but only altruistic surrogacy, under the Surrogacy (Regulation) Act, 2021. A married Indian couple with a certified medical need (or an eligible widow or divorcee) can apply. Commercial surrogacy, where the surrogate is paid, is banned. How are IVF and surrogacy connected?IVF और सरोगेसी का क्या संबंध है?
Gestational surrogacy uses IVF. The embryo is made in the lab from the couple’s egg and sperm (or one donor gamete, if the Medical Board allows it) and then transferred to the surrogate’s womb. No. Brokers and agents that arrange surrogates are prohibited. What happens after I apply at the CMO office?CMO कार्यालय में आवेदन के बाद क्या होता है?
The Chief Medical Officer’s office (the district Appropriate Authority) checks the file and issues an office order fixing a meeting of the District Level Authorization Committee. In one state the committee was the Chief Medical Officer (chair), the District Attorney, the Medical Officer of Health (member-secretary) and a member from an NGO. The couple is asked to attend with all original documents of the couple and the surrogate. After the meeting the certificates are issued. How many times can the embryo transfer be tried?भ्रूण ट्रांसफ़र कितनी बार किया जा सकता है?
Up to three attempts on the same surrogate mother, under the Surrogacy (Regulation) Rules, 2022. Usually one embryo is placed in each attempt; up to three may be placed only in special cases, as the doctor decides. The surrogate’s eligibility certificate (Form 17B) may repeat this limit in its terms. If the attempts do not succeed, a new surrogate needs her own consent, fitness and eligibility papers and a fresh court order. What if the first transfer does not work?पहला ट्रांसफ़र सफल न हो तो?
Success rates are below 100% even in healthy cases. Ask your doctor whether the same surrogate can try again and whether your existing certificates still cover another attempt. A new surrogate needs her own consent, fitness and eligibility papers and a fresh parentage application.स्वस्थ मामलों में भी सफलता दर 100% से कम होती है। अपने डॉक्टर से पूछें कि वही सरोगेट दोबारा कोशिश कर सकती है या नहीं और मौजूदा प्रमाणपत्र दूसरी कोशिश के लिए मान्य हैं या नहीं। नई सरोगेट के लिए उसकी अपनी सहमति, स्वास्थ्य और पात्रता के कागज़ात और नया पितृत्व आवेदन चाहिए।

No. The surrogate never uses her own egg. The embryo is made from the couple’s egg and sperm, or, where the Medical Board allows it, one of the couple’s gametes and a donor’s.
